Terms of Trade and DisclaimersTERMS OF TRADE Craddocks Airport Car Storage Contract 1. These terms of trade form the contract between Christchurch International Airport Limited trading as Craddocks Airport Car Storage (“Craddocks”) and Craddocks’ customer (“you”). Craddocks may amend these Terms and Conditions from time to time in its sole discretion. Fees 2. In consideration for payment of the relevant fees by you (“the Fees”), Craddocks agrees to provide the services selected by you (“the Services”). 3. In the event that you wish to change the Services initially requested, then you agree that any services subsequently requested and changes to the Services will be deemed to be “Services”. 4. In the event that you have not paid the Fees required for the Services (or any part of them) in advance, you agree to pay the Fees on invoice by Craddocks. 5. Any Fees not paid on or before their due date will incur interest at the rate of 10% per annum from their due date until the date of payment (whether before or after judgment is entered). 6. Fees may be paid by cash, major credit cards, Combined Rural Traders card or Ashburton Trading Society Card. In the event of payment by credit card, we reserve the right to charge an appropriate surcharge to compensate us for fees we have to pay to your credit card company in respect of the Fees. Services 7. Craddocks will perform the Services in a good and workmanlike manner and agrees to exercise all reasonable care in relation to your vehicle. 8. You acknowledge that some Services may require Craddocks to move your vehicle to another site for work to be undertaken by a third party, at Craddocks’ sole discretion. Abandonment 9. In the event that you leave your vehicle at Craddocks and have not uplifted your vehicle from Craddocks’ premises within 2 days of the agreed date and you have not made alternative arrangements with Craddocks for the continued storage of your vehicle, you authorise Craddocks to remove your vehicle from its premises and park it on the roadside in the vicinity of Craddocks’ premises. Craddocks will use all reasonable endeavours to contact you using the contact details provided by you before removing your vehicle in this manner. 10. In the event that Craddocks leaves your vehicle on the roadside in accordance with clause 9 above, Craddocks will leave your vehicle locked (if the vehicle is reasonably capable of being locked). Craddocks will store your key at its premises and your key may be uplifted from Craddocks during its business hours on payment of any outstanding Fees. 11. In the event that Craddocks forms the view that your vehicle poses a danger to people or property, Craddocks may remove your vehicle from its premises and park it on the roadside or at another location determined by Craddocks. Unless removal is required urgently (in Craddocks’ sole discretion), Craddocks will use all reasonable endeavours to contact you using the contact details provided before removing your vehicle in this manner. 12. Removal of your vehicle from Craddocks’ premises in the manner described in clause 9 and 11 above does not relieve you of any obligation to pay the Fees. Information collected 13. Craddocks may retain any information provided by you to assist with future bookings and, if you have an account with Craddocks, to administer your account. Such information may be stored electronically using a cloud computing service or other internet based storage or at a remote location, in either case based in New Zealand or overseas at Craddocks’ sole discretion. 14. You may have access to information we hold about you at any time on reasonable notice, and we will correct any errors in that information as advised by you on reasonable notice. |
